The petitioner was sentenced to imprisonment for a term of not less than two nor more than ten years, following his conviction
under the Narcotic Drug Act, which
[75 NM Page 539]
provides (§ 54-7-15, N.M.S.A. 1953) that probation or parole shall not be granted until the minimum imprisonment provided
for the offense shall have been served. Petitioner's parole was authorized by the state parole board to become effective December
24, 1964, less than two years after the sentence, but was cancelled when the statutory prohibition against parole was called
to the attention of the board.
